Welcome! The terms "Paintable Pictures," "we," "our," and "us" refer to Paintable Pictures LLC and our affiliates. We operate product brands including Colorables and other personalized product services. This includes e-commerce storefronts such as shop.colorables.com and AI-powered applications such as colorables.com that generate personalized coloring books, stickers, magnets, and other products (collectively, the "Services"). These Terms of Service ("Terms") govern your access to and use of the Services, along with any other policies referenced here.
By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use or access the Services.
The Services include: (a) our Shopify-powered retail storefronts that offer physical kits and related goods; (b) our web applications where authenticated users upload photos, generate personalized products (such as coloring books, stickers, and magnets), redeem credits, and manage their accounts; and (c) any communications, customer support, or marketing experiences associated with those offerings.
By using the Services, you represent that you are at least the age of majority in your jurisdiction for purchasing goods and that you are at least 13 years old to access the app experiences. If you allow a minor dependent to use a device you own, purchase, or manage, you accept responsibility for their activity. The Services are not intended for children under 13.
Placing an order constitutes an offer to purchase. We reserve the right to accept, decline, or cancel orders at our discretion, including after submission. We must process payment before accepting an order, and we will attempt to notify you if an order changes or cannot be fulfilled.
Shipping and delivery timelines are estimates only and may be affected by carrier delays, customs processing, or events outside our control. Title and risk of loss pass to you when products are transferred to the carrier.
Returns, refunds, and exchanges are governed by our Refund Policy or any updated policy presented at checkout.
Generation credits and redemption codes have no cash value, may expire per their stated terms, are non-transferable, and may be void if obtained through unauthorized means.
Our applications enable you to upload photos and generate personalized products. You retain ownership of photos you upload and the generated designs, subject to these Terms.
The Services, including all trademarks, logos, text, images, graphics, video, audio, design, and compilation, are owned by Paintable Pictures LLC, Shopify, or our licensors and are protected by intellectual property laws. You may access the Services for personal, non-commercial use only.
You may use the Services only for lawful purposes. You may not, directly or indirectly:
We may monitor activity, remove content, and suspend or terminate access if we believe these Terms have been violated.
You may receive access to optional tools or links operated by third parties. These are provided “as is” and “as available” without any endorsement, warranties, or liability. Use third-party services at your own risk and review their terms and policies before engaging in transactions.
Our Services are powered by Shopify, which enables us to provide the Services to you, and certain in-app payments are processed by Stripe. However, any sales and purchases you make in our stores are made directly with Paintable Pictures LLC. By using the Services, you acknowledge and agree that Shopify and Stripe are not responsible for any aspect of any sales between you and Paintable Pictures, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify, Stripe, and their affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Paintable Pictures.
All personal information collected through the Services is subject to our Privacy Policy, which explains how we, Shopify, and our partners process your data. Because the Services are hosted by Shopify, your information may be transmitted to and processed by Shopify and its service providers in other countries. Review both privacy policies for details.
If you submit reviews, suggestions, or other feedback (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, and display that Feedback for any purpose. You represent that you have the rights to provide the Feedback and that it does not violate any law or third-party rights. We may monitor, edit, or remove Feedback we deem objectionable but have no obligation to do so.
We may change, suspend, or discontinue any part of the Services at any time without notice. Occasionally, the Services may contain typographical errors, inaccuracies, or omissions (for example, product descriptions, pricing, promotions, shipping charges, or availability). We reserve the right to correct errors and update information without prior notice, including after you submit an order.
We may terminate or suspend your access to the Services for any reason, including violation of these Terms or applicable law. You remain responsible for all amounts due through the date of termination. Certain provisions of these Terms, by their nature, survive termination (including intellectual property, feedback, disclaimers, limitation of liability, indemnification, dispute resolution, governing law, and other provisions that should reasonably survive).
EXCEPT AS EXPRESSLY STATED BY PAINTABLE PICTURES, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, DURABILITY, OR NON-INFRINGEMENT. We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free, or that the results obtained will meet your expectations.
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER PAINTABLE PICTURES NOR OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, LICENSORS, OR THE EQUIVALENT PERSONNEL OF SHOPIFY AND ITS AFFILIATES WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR SIMILAR DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY.
You agree to indemnify, defend, and hold harmless Paintable Pictures, Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, claims, or expenses (including reasonable attorneys' fees) arising out of or related to:
We will notify you of any indemnifiable claim, and failure to do so will not relieve your obligations unless you are materially prejudiced. We may control the defense and settlement of any claim at your expense, provided we will not agree to obligations that bind you without your consent (not to be unreasonably withheld). You must cooperate in the defense.
These Terms and any separate agreements whereby we provide the Services are governed by the laws of the State of Ohio, U.S.A., without regard to conflict of law principles. Any dispute, claim, or controversy arising out of or relating to the Services or these Terms will be resolved through binding arbitration administered by the American Arbitration Association in Franklin County, Ohio, in accordance with its Commercial Arbitration Rules. You and Paintable Pictures waive the right to participate in class actions or class-wide arbitration. Nothing in this section prevents either party from seeking injunctive relief in court to protect intellectual property or confidential information, or from pursuing a claim in small claims court if it qualifies.
You may not assign, transfer, or delegate these Terms without our prior written consent, and any attempt to do so is void. We may assign or delegate these Terms and our rights and obligations without notice or consent.
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver. These Terms and any policies or operating rules we post constitute the entire agreement between you and Paintable Pictures and supersede prior agreements. Headings are for convenience only and do not affect interpretation.
We may update these Terms by posting a revised version on this page. It is your responsibility to check for changes. When required by law, we will provide notice of material updates. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
